Terms of Service

These Terms of Service ("Terms") are an agreement between you and PlayPalz Inc. ("PlayPalz," "we," "our," or "us") and govern your use of the PlayPalz mobile apps and website (the "Service"). By creating an account or using the Service you agree to these Terms, to our Community Guidelines, and to our Privacy Policy. If you do not agree, do not use the Service.

1. Zero tolerance for objectionable content and abusive users

PlayPalz has no tolerance for objectionable content or abusive users. You may not post, stream, send or share anything that violates the Community Guidelines, including harassment, hate, threats, sexual content involving minors, sexual solicitation of minors, nudity or pornography, graphic violence, scams or illegal activity. We remove content that breaks these rules and suspend or permanently ban the accounts responsible, without warning where the violation is serious.

2. Who can use PlayPalz

• You must be at least 13 years old to create an account.
• If you are under 18, you may only use the Service with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.
• Some features are for adults only. E-dates require you to be 18 or older and to verify your age with a photo ID. Cashing out earnings and becoming a creator also require you to be 18 or older. Users under 18 can only exchange direct messages with people they mutually follow.
• The date of birth you give us must be accurate. You cannot change it in the app once set.
• You may not use the Service if we have previously banned you or if the law prohibits you from using it.

3. Your account

• Give accurate information and keep it up to date. Do not impersonate anyone.
• Keep your password secret. You are responsible for activity on your account. Tell us right away at playpalz@playpalz.gg if you think someone else has accessed it.
• One person per account. Accounts may not be sold, rented or transferred.
• You can delete your account at any time in the app under Settings → Delete Account.

4. Your content

You own the posts, clips, comments, messages, livestreams and other content you create ("Your Content"). By posting it, you give PlayPalz a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display and distribute Your Content in order to operate, promote and improve the Service. This license ends when you delete the content or your account, except where the content was shared with others who have not deleted it, or where we must keep it for legal or safety reasons.

You are responsible for Your Content. You confirm that you have the rights to post it and that it does not break these Terms, the Community Guidelines or the law. We may remove or restrict any content, and may review content reported to us, to keep the Service safe.

5. Reporting, blocking and moderation

• You can report content and users, block users, and hide comments on your own posts from inside the app.
• Blocking someone stops them from messaging you and from seeing or interacting with your content.
• We review reports within 24 hours. Depending on the severity, we may remove content, restrict features, suspend or permanently ban accounts, and, where required, report illegal content (including any child sexual abuse material) to law enforcement and the National Center for Missing & Exploited Children.
• If you think we made a mistake, email playpalz@playpalz.gg and we will take another look.

6. Play Coins, VIP passes and purchases

• Play Coins are a virtual currency for tipping and unlocking content on PlayPalz. They have no cash value, cannot be exchanged for money (except creators cashing out earnings under section 8), and cannot be transferred outside the Service.
• Purchases made in the iOS or Android app are processed by Apple or Google and are subject to their terms and refund policies. Purchases are final except where the store or the law requires a refund.
• VIP passes unlock a creator's subscriber content and rooms for the period shown at purchase.
• We may change prices, limits (including daily tipping limits, which are lower for users under 18) and what Play Coins can be used for. Coins may be forfeited if your account is banned for breaking these Terms.

7. Sessions, e-dates and livestreams

• Sessions and e-dates are 1-on-1 video calls with a verified PlayPal at a booked time. Each host decides whether they accept bookings from users under 18. E-dates are only available between adults whose age has been verified.
• Sessions, e-dates and livestreams are covered by the Community Guidelines. Sexual content, nudity and any request for off-platform payment or contact are not allowed and will lead to a ban.
• Do not record or share another person's session, call or stream without their permission.

8. Creators and payouts

• To earn on PlayPalz you must be 18 or older, pass identity verification and connect a payout account through Stripe. Stripe's Connected Account Agreement also applies to you.
• Earnings from tips, VIP passes and bookings are shown in the app and paid out under the schedule and fees shown there. We may hold or reverse earnings tied to refunds, chargebacks, fraud or violations of these Terms.
• You are responsible for any taxes on your earnings.

9. Things you must not do

• Break the law or help anyone else do so, or violate anyone's rights, including intellectual property.
• Spam, scam, phish, or sell or advertise without our permission.
• Access the Service with bots or scrapers, or try to get around security, rate limits, age limits or blocks.
• Interfere with or disrupt the Service, or upload malware.
• Create a new account to get around a suspension or ban.

10. Suspension and termination

We may suspend or end your access to the Service, and remove your content, if you break these Terms or the Community Guidelines, if we must for legal reasons, or to protect other users. You may stop using the Service and delete your account at any time.

11. Disclaimers and limitation of liability

The Service is provided "as is" and "as available." We do not guarantee that it will always be available or error-free, and we are not responsible for content posted by users or for interactions between users, on or off the Service. To the fullest extent allowed by law, PlayPalz is not liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Some jurisdictions do not allow these limits, so they may not apply to you.

12. Changes to these Terms

We may update these Terms. When we make material changes we will update the date above and tell you in the app or by email. If you keep using the Service after the changes take effect, you accept the updated Terms.
